家庭类别

家庭类别旨在通过向新西兰公民和居民的家庭成员授予居留签证,帮助在新西兰团聚家庭。要在此类别下获得资格,您必须是新西兰公民或居民的以下亲属:

  • 伴侣

  • 受抚养子女

  • 父母

伴侣

要根据伴侣类别获得居留签证,申请人必须提供足够的证据,使新西兰移民局 (INZ) 确信他们与新西兰公民或居民已在真实且稳定的伴侣关系中共同生活 12 个月或更长时间。就这些条款而言,“伴侣关系”是指:i. 合法婚姻;或 ii. 民事结合(无论是异性还是同性);或 iii. 事实上的关系(无论是异性还是同性),而“伴侣”是指上述 (i)、(ii) 和 (iii) 中此类伴侣关系的一方。在每种情况下,证明申请所依据的伴侣关系是真实且稳定的责任都由主要申请人及其新西兰伴侣承担。

受抚养子女

要被视为受抚养人,子女必须完全或主要依赖成人提供经济支持,无论是否与该成人同住。担保成人必须是新西兰公民或居民。父母或法定监护人必须作为以下身份合法且永久地居住在新西兰:

  • 新西兰公民;

  • 新西兰居留签证持有人;

  • 居住在新西兰的澳大利亚公民。

受抚养子女的年龄也可以在 24 岁以下,并且必须满足所有资格要求才能获得新西兰居留权。

父母

1. 父母退休类别

(a) 要根据父母退休类别批准申请,主要申请人必须:

  • 提名价值至少 100 万新西兰元的资金和/或资产;并且

  • 承诺将其投资在新西兰四年;并且

  • 证明拥有这些资金和/或资产,并且这些资金和/或资产是合法赚取或获得的;并且

  • 按照新西兰移民局的指示转移资金并将其投入可接受的投资;

  • 提名 50 万新西兰元的安家资金,并证明拥有这些资金和/或资产;

  • 证明年收入至少为 6 万新西兰元;并且

  • 满足以下家庭要求:

    • 主要申请人必须:

      • 是居住在新西兰的成年子女的父母,并且该子女是新西兰公民或持有(或被视为持有)不受 2009 年《移民法》第 49 条条件限制的居留签证;并且

      • 没有受抚养子女。

(b) 主要申请人及其申请中包含的任何次要申请人都必须满足健康和品格要求。

2. 父母类别

只有在以下情况下,个人才能根据父母类别申请居留签证:

  • 他们已收到根据父母类别发出的申请邀请;

  • 他们在邀请他们申请的信函日期后的四个月内根据父母类别申请居留签证;并且

  • 该邀请尚未被撤销。

健康、品格和英语语言要求 根据父母类别申请的人必须满足:

  • 如规定的健康和品格要求;

  • 最低英语水平,或预先购买达到规定水平的英语(非英语母语者)辅导课程。

家庭关系

(a) 父母必须: * i. 由上述成年子女担保,该子女必须是合格的担保人。 * ii. 证明他们符合家庭关系要求。

(b) 父母类别下的申请人不得有受抚养子女。

(c) 申请人的担保人在其希望担保的申请提交之日前的至少三年内,必须一直是新西兰公民和/或新西兰居民;并且

(d) 申请人的担保人必须满足申请人作为居民在新西兰居住的前 5 年的承诺。

双层系统

父母类别下的申请人必须符合以下任一条件:

1. 第一层

满足以下任一要求:

  • i. 有一名担保人(如果适用,包括该担保人的伴侣)满足以下最低年收入水平;或者

    • 担保人或其伴侣的年收入必须至少为 65,000 新西兰元;或者

    • 担保人及其伴侣的年收入合计必须至少为 90,000 新西兰元。

  • ii. 拥有足够的有保障的终身最低收入,如下:

    • 如果申请中只包含一名申请人,该申请人必须拥有至少 27,203 新西兰元(税前)的保障性终身最低收入。

    • 如果申请中还包含伴侣,则申请人双方必须共同拥有至少 39,890 新西兰元(税前)的保障性终身最低收入。

  • iii. 将足够的安家资金带到新西兰,如下:

    • 主要申请人必须:

2. 第二层

满足以下要求:

  • i. 他们有一位满足第二层最低收入(每年 33,675 新西兰元)的担保人。

  • ii. 申请人的其他成年子女(如果有)合法且永久地居住在申请人合法且永久居住的国家之外。

 

Family Category

The Family Category helps to reunite families in New Zealand by granting a Residence Visa to the family members of New Zealand citizens and residents. To qualify under this category you must be related to a New Zealand citizen or resident as

  • Partner

  • Dependent Child

  • Parent

Partner

To be granted a residence class visa under Partnership Category applicants must provide sufficient evidence to satisfy INZ that they have been living together for 12 months or more in a partnership that is genuine and stable with a New Zealand citizen or resident. For the purpose of these instructions ‘partnership’ means: i. a legal marriage; or ii. a civil union (whether opposite or same sex); or iii. a de facto relationship (whether opposite or same sex) and ‘partner’ means one of the parties to such a partnership indicated in (i), (ii) and (iii) above. In each case the onus of proving that the partnership on which the application is based is genuine and stable lies with the principal applicant and their New Zealand partner.

Dependent Child

To be dependent, the child has to be totally or substantially reliant on an adult for financial support, whether living with that adult or not. Sponsoring adults must be New Zealand citizens or residents. The parent or legal guardian must be living lawfully and permanently in New Zealand as a:

  • New Zealand citizen;

  • New Zealand Residence Class Visa holder

  • Citizen(s) of Australia living in New Zealand.

  • Dependent children can also be up to the age of 24, and must meet all eligibility requirements to qualify for residence in New Zealand.

Parent

1. Parent Retirement Category

a. For an application to be approved under the Parent Retirement Category the principal applicant must:

  • nominate funds and/or assets equivalent in value to at least NZ$1 million and

  • undertake to invest them in New Zealand for a period of four years; and

  • demonstrate ownership of these funds and/or assets and that they have been

  • legally earned or acquired; and

  • transfer and place the funds in an acceptable investment in accordance with

  • INZ’s instructions

  • nominate NZ$0.5 million of settlement funds and demonstrate ownership of  these funds and/or assets;

  • demonstrate an annual income of at least NZ$60,000; and

  • meet the Family requirements as follows:

The principal applicant must:

  • be the parent of an adult child who is in New Zealand and is a New Zealand citizen or the holder (or deemed to be the holder) of a residence class visa that is not subject to conditions under section 49 of the Immigration Act 2009; and

  • have no dependent children

b. The principal applicant and any secondary applicant included in the application must meet health and character requirements.  

2. Parent Category

A person may only apply for a resident visa under the Parent Category if:

  • they have been issued an invitation to apply under the Parent Category;

  • they apply for a resident visa under the Parent Category within four months of the date of the letter inviting them to apply; and

  • that invitation has not been revoked.

Health, character and English language requirements Applicants under the Parent Category must meet:

  • the health and character requirements  as specified

  • a minimum standard of English, or pre-purchase English for Speakers  of Other Languages tuition to the specified level

Family relationships

a. The parent(s) must:

i. be sponsored by the adult child referred to who is an acceptable sponsor.

ii. demonstrate they meet the family relationship requirements.

b. An applicant under Parent Category must have no dependent children.

c. The applicant’s sponsor must have been a New Zealand citizen and/or New Zealand resident for at least three years immediately preceding the date the application they wish to sponsor is made; and

d. The applicant’s sponsor must meet the undertakings set out for the first 5 years of the applicant’s stay in New Zealand as a resident.

Two tiered system

Applicants under the Parent category must qualify either under:

1. Tier One

Meet one of the following requirements:

i.     have a sponsor (and, if applicable, that sponsor’s partner) who meets a minimum annual income level for as follows; or

  • a sponsor or their partner must earn a minimum of $65,000 per annum; or

  • a sponsor and their partner together must earn a minimum of $90,000 per annum

ii. have a sufficient guaranteed lifetime minimum income as follows; or

  • If there is one applicant included in the application, the applicant must have a guaranteed lifetime minimum income of at least $27,203 gross per annum.

  • If a partner is also included in the application, the applicants jointly must have a guaranteed lifetime minimum income of at least $39,890 gross per annum.

iii    bring sufficient settlement funds to New Zealand as follows:

Principal applicants must:

  • nominate funds (or assets that can be converted into funds) to bring to New Zealand of a minimum value of NZ$500,000; and

  • demonstrate ownership of the nominated funds and/or assets demonstrate that the nominated funds and/or assets have been earned or acquired legally

Funds or assets may be owned either solely by the principal applicant;  or jointly by the principal applicant and their partner who is included in the resident visa application.

2. Tier Two

Meet the requirements:

i. they have a sponsor who meets a minimum income for Tier Two of  $33,675 per annum.

ii. The applicants’ other adult children (if any) live lawfully and permanently outside the country in which the applicant lives lawfully and permanently. applicants’ other adult children (if any) live lawfully and permanently outside the country in which the applicant lives lawfully and permanently
